This message is directed to Roger Flahaven. I'm a tenured professor at the University of Illinois at Chicago. The University Ethics Officer has told the Office of the Secretary of State that I'm required by 5 ILCS 420/4A to file a Statement of Economic Interests. That's plainly erroneous, but the University Ethics Officer has so far failed to correct the error. As a result, the Office of the Secretary of State is threatening me with fines and termination of employment, in breach of the substantive and due-process protections in my tenured employment contract. 5 ILCS 420/4A authorizes penalties only upon people actually required to file, but the Office of the Secretary of State says that they will impose penalties on everyone named by the University Ethics Officer, never mind the law. The Office of the Secretary of State is hiding some of the procedures that they will use to impose the threatened penalties. In particular, I'm under the impression that the Office of the Secretary of State will send you some sort of ``noncompliance list''; but the Office of the Secretary of State has been thoroughly unresponsive to my questions regarding this list. Exactly what information does the Office of the Secretary of State send you? When is this information sent? What do you do with it? Do you have any formal error-correction procedures?
